In Kansas children can be charged with a sex crime if they have consensual sex. There are many prosecutors and defense attorneys who have believed that BOTH children can be charged with a crime! As a result many juvenile defendants have pleaded guilty to something that was not against the law. This case directly challenged the propriety of dually charging children and asked the appeal court to rule that ONLY THE OLDER child be charged as that is what the law says. The Court agreed!
